Privacy Policy

1Scope

This Privacy Policy explains how Sleep Balance Academy PC collects, uses, discloses, and retains personal information when you use our public websites, create an account, purchase retail products or educational content, contact customer support, or interact with other non-clinical services. Protected health information created or maintained in connection with patient care is governed by our Notice of Privacy Practices and applicable health privacy law. Certain health-related information that is not protected health information may be governed by our Consumer Health Data Privacy Notice. Where more than one notice could apply, we apply the rule that provides the greater protection required by law.

2Information We Collect

We may collect the following categories of personal information:

• Contact information, such as name, postal address, email address, and telephone number.
• Account information, such as login identifiers, authentication records, saved addresses, preferences, and account history.
• Transaction information, such as products or digital content purchased, amounts charged, discounts, tax, shipping status, returns, refunds, and subscription status. Payment card information is processed by our payment providers; SBA does not need to store a full card number to complete ordinary transactions.
• Communications and public content, such as customer-support messages, product questions, surveys, and reviews you choose to post publicly.
• Device and usage information, such as IP address, browser and device type, security events, pages requested, and information generated by cookies or similar technologies.
• Marketing and privacy choices, such as email preferences, cookie choices, and opt-out signals.

3Sources

We collect information directly from you, automatically from your browser or device when you use our websites, and from service providers that help complete a transaction or protect the service, such as payment processors, carriers, identity and fraud-prevention providers, and customer-support vendors. We do not purchase clinical records or patient health information from data brokers.

4How We Use Personal Information

We use personal information as reasonably necessary to provide requested products and services; create and secure accounts; process payment, shipping, returns, subscriptions, and refunds; provide customer support; administer educational content; prevent fraud and security incidents; comply with legal, accounting, tax, product-safety, and regulatory obligations; maintain and improve the public website; and send marketing communications where permitted and consistent with your choices. We do not use protected health information from patient care to create advertising audiences or to target consumer advertising.

5When We Disclose Personal Information

We may disclose personal information to service providers and processors that perform functions for us, including payment processing, fulfillment, shipping, hosting, authentication, communications, customer support, security, analytics, and professional services. They receive only information reasonably necessary for the function they perform and are subject to contractual or legal restrictions appropriate to that function.

We may disclose information when required by law or valid legal process, to protect rights or safety as permitted by law, or in connection with a merger, acquisition, financing, reorganization, or sale of relevant business assets, subject to applicable privacy obligations. Protected health information is disclosed only as permitted by the Notice of Privacy Practices and applicable health privacy law.

6Analytics, Advertising, and Sale or Sharing

On designated non-clinical public pages, we may use analytics or advertising services, including services provided by Google or Meta, subject to the consent and opt-out rules that apply to the visitor. Depending on state law, disclosures made through advertising technology can constitute a 'sale,' 'sharing,' or use for targeted advertising even when no money is exchanged for personal information. SBA does not sell personal information for money. We do not permit advertising technologies to receive protected health information, appointment information, clinical communications, patient-portal activity, or consumer health data as described in our Consumer Health Data Privacy Notice. Our Cookie and Tracking Notice describes the controls used on public pages.

7Retention

We retain personal information for as long as reasonably necessary for the purpose for which it was collected and to satisfy legal, accounting, tax, fraud-prevention, contract, product-safety, and dispute obligations. Different records have different retention periods. Clinical records are retained under the laws applicable to the care and are not governed by a general website-retention schedule.

8Security

We use administrative, technical, and physical safeguards designed to protect personal information in light of its sensitivity and our legal obligations. We restrict access based on role and legitimate need. No security program can guarantee that an incident will never occur; when a breach or security incident triggers a legal notice obligation, we provide the notices required by applicable law.

9State Privacy Rights

Depending on where you live and the law that applies to a particular processing activity, you may have rights to confirm processing, access personal information, obtain a portable copy, correct inaccuracies, request deletion, opt out of sale, sharing or targeted advertising, limit certain uses of sensitive information, and appeal a denial of a request. To submit a request, email support@sleepbalanceacademy.com with the subject line 'Privacy Request.' We may take reasonable steps to verify your identity or an authorized agent's authority. We will not unlawfully discriminate against you for exercising a privacy right.

10Global Privacy Control

Where applicable law requires recognition of a browser-based opt-out preference signal, including Global Privacy Control, we treat a valid signal as an opt-out for the browser or device from covered sale, sharing, or targeted-advertising activity. You may also use the privacy controls provided on the website.

11Children

Our public retail website is not directed to children under 13, and we do not knowingly collect personal information from a child under 13 through the public store without authorization required by law. Clinical information about a minor patient is handled under the Notice of Privacy Practices and the laws governing minors and personal representatives.

12Changes and Contact

We may update this Policy to reflect changes in law or our practices. The effective date above identifies the current version. If applicable law requires additional notice or consent for a material change, we will provide it.
