Formal Legal Notices
Unless a specific contract or law provides another method, formal legal notices to SBA should be in writing and delivered to: Sleep Balance Academy PC, Attention: Legal Notices, 1749 Creek Wood Dr, Dubuque, IA 52004. Email to customer support is not consent to service of process or formal legal service unless SBA has expressly agreed in writing for the particular matter or applicable law provides otherwise. Nothing in this section changes a legally required method of service.
Copyright and Trademarks
Website text, graphics, photographs, videos, course materials, software, and other content are owned by or licensed to SBA and are protected by intellectual-property law. Sleep Balance Academy and associated logos and brand identifiers are trademarks or service marks of SBA or its licensors. No license to use SBA branding is granted except as expressly authorized in writing.
Copyright Complaints
A copyright owner or authorized agent who believes material on an SBA-controlled website infringes a copyright may send a notice to the Legal Notices address above or to support@sleepbalanceacademy.com with the subject line 'Copyright Notice.' A notice should include the information required by 17 U.S.C. 512(c)(3), including identification of the copyrighted work and allegedly infringing material, contact information, the required good-faith and accuracy statements, and a physical or electronic signature. A person whose material is removed in response to a qualifying notice may submit a counter-notice containing the information required by 17 U.S.C. 512(g). Knowingly material misrepresentations in notices or counter-notices can create liability under federal law.
Legal Process and Government Requests
Requests for records or legal process should identify the issuing authority, matter, records requested, relevant time period, and contact information. SBA responds to valid legal process and applicable law and will assert available objections to requests that are facially defective, overbroad, or inconsistent with privacy law. Protected health information and records protected by 42 CFR part 2 are disclosed only when the legal requirements governing those records have been satisfied. A general request or subpoena does not automatically authorize every disclosure of patient information.
Security Vulnerability Reports
To report a suspected security vulnerability, email support@sleepbalanceacademy.com with the subject line 'Security Report.' Do not access, retain, alter, or disclose patient information to prove a vulnerability. Stop testing if patient or other sensitive information becomes accessible and report the issue with the minimum information necessary to allow SBA to investigate.
Regulatory and Patient Rights
Nothing in SBA's website terms or policies prevents a patient, consumer, clinician, or other person from making a lawful report or complaint to a licensing board, HHS Office for Civil Rights, the Federal Trade Commission, the Food and Drug Administration, a state attorney general, law enforcement, or another government authority. Nothing authorizes retaliation for exercising a protected right.
