Equipment Is Loaned, Not Sold
Home sleep study equipment issued to you for a clinical study remains the property of SBA or the identified equipment owner. The loan may include a recorder, sensors, cables, charger, case, instructions, and other accessories identified when the equipment is issued. No ownership interest transfers to you.
Permitted Use
Use the equipment only for the patient and study for which it was issued and only according to the instructions provided. Do not lend, sell, pledge, alter, open, repair, or use the equipment for another person. Keep it reasonably protected from water, extreme temperatures, pets, children, avoidable impact, and other foreseeable damage.
Health Information on the Equipment
A device may create or temporarily store information from your study. Health information created or received in connection with the study is handled under our Notice of Privacy Practices and applicable law. Do not attempt to access, copy, alter, or delete device data except as specifically instructed.
Return
Unless you are given a different written instruction for your study, return the loaned equipment within 14 days after the study is completed or after SBA tells you the study will not proceed. Use the prepaid return method supplied or contact support@sleepbalanceacademy.com if a label, package, or other return arrangement is needed. You should not pay return postage that SBA has agreed to provide.
Loss, Damage, or Missing Equipment
Notify us promptly if equipment is lost, stolen, materially damaged, or cannot be returned on time. Ordinary wear, equipment malfunction, and damage not caused by misuse will not result in a patient charge. If equipment is intentionally retained, sold, materially damaged through misuse or reckless handling, or not returned after reasonable notices and an opportunity to arrange return, SBA may seek the reasonable repair or replacement cost only to the extent the charge was disclosed or separately agreed and is permitted by law. No replacement charge is authorized merely by accepting this Agreement unless the amount or method of determining it has been disclosed to you.
Effect on Care and Records
Failure to return equipment does not waive your rights to access a completed medical record or report. A study result may nevertheless be delayed when the recording cannot be retrieved until the physical device is returned. SBA may also decline to issue additional loan equipment until prior equipment is returned, when doing so is consistent with patient safety and applicable law.
Withdrawal or Cancellation
You may decline or discontinue a home sleep study subject to your clinical plan and applicable law. If you do, return the equipment promptly. Returning equipment does not itself cancel an appointment, claim, or other clinical service; contact your care team if you are changing the plan of care.
Acceptance
By affirmatively accepting this Agreement and accepting possession of the equipment, you acknowledge that the equipment is a temporary loan, agree to reasonable care and return obligations, and understand that the health information created by the study is governed separately by health privacy law.
